Terms of Use

Effective date: October 6, 2026

These Terms of Use ("Terms") are an agreement between you and Upcraft ("Upcraft", "we", "us") and cover your use of the Upcraft iOS app and upcraft.art (the "Service"). By using the Service you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use Upcraft

You must be at least 13 years old (or the minimum age of digital consent where you live). If you're under 18, you need a parent or guardian's permission. If you use the Service for a business or channel you manage, you confirm you're authorized to act for it.

2. The Service is free

Upcraft is currently free, with no subscription and no watermark. So it stays free for everyone, we apply fair-use limits, for example a number of thumbnail generations per day. We may change these limits, add or remove tools, or pause features at any time, for example to manage costs or abuse. If we ever introduce paid features, we'll tell you clearly first, and nothing will be charged without your explicit purchase through the App Store.

3. Anonymous accounts

The app creates an anonymous account on your device. If you delete the app or reset your device, you may lose access to your history. You're responsible for activity on your device. Don't try to get around fair-use limits, for example by automating requests, tampering with the app, or resetting identifiers.

4. YouTube features

Connecting a YouTube channel uses YouTube API Services. By using these features you agree to be bound by the YouTube Terms of Service, and your information is handled under the Google Privacy Policy. Access is read-only, and you can revoke it at any time on the Google permissions page. Upcraft isn't affiliated with, endorsed by or sponsored by YouTube or Google. Only connect channels you own or are authorized to manage.

5. Your content

"Your Content" means the text you enter, the photos you upload, and your channel's materials you let us use. You keep all rights to it. You give us a worldwide, non-exclusive, royalty-free license to host, process, transmit and modify Your Content only as needed to run the Service for you, including sending it to the AI providers listed in our Privacy Policy. This license ends when you delete the content, except for routine backups that expire on their own.

You promise that you have the rights to Your Content, and that any person who appears in a photo you upload is you, or has given you permission to use their likeness this way.

6. Generated thumbnails

As between you and Upcraft, you own the thumbnails the Service generates for you ("Outputs"), and you may use them commercially, including on YouTube. This is subject to the terms of the underlying model providers (including OpenAI's terms and fal.ai's terms) and to the law. AI can produce similar Outputs for different users, so Outputs may not be unique, and we can't guarantee they're free from third-party rights. You're responsible for reviewing an Output before you publish it.

We may keep anonymized, aggregated statistics (for example how many thumbnails are generated). We don't use your photos or prompts to train AI models.

7. Acceptable use

You agree not to use the Service to create, upload or share content that:

• impersonates a real person or brand, or shows a real person (including public figures) without their consent in a way that's deceptive, defamatory, sexual or harmful;
• is a deceptive thumbnail of a real person, for example showing someone saying or doing something they didn't, or fake endorsements;
• infringes copyrights, trademarks or other rights, for example copying another creator's thumbnail or logo;
• is sexually explicit, involves minors in any sexual or exploitative context, or is violent extremist, hateful or harassing;
• promotes illegal activity, scams, medical or financial misinformation, or breaks YouTube's Community Guidelines or spam and misleading-metadata policies;
• is meant to mislead viewers about what a video contains in a way that harms them.

You also agree not to reverse engineer, scrape or overload the Service, get around rate limits or security (including App Check), use it to build a competing dataset or model, or access it by automated means. We and our AI providers may block requests or remove content that breaks these rules, and suspend access.

8. AI output and no professional advice

Style analysis, grades and suggestions are generated automatically and may be wrong or incomplete. They aren't a promise of more views, clicks or revenue.

9. Third-party services

The Service relies on third parties (such as Apple, Google/Firebase, YouTube, fal.ai, OpenAI, Anthropic and Meta). Their services have their own terms, and we're not responsible for them. Your use of the App Store is governed by Apple's terms. Apple has no obligation to provide maintenance or support for the app.

10. Our intellectual property

The Service, including the Upcraft name, logo, software and design, belongs to us and our licensors. We give you a personal, revocable, non-transferable license to use the app on Apple devices you own or control, under these Terms and the App Store usage rules.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT OUTPUTS WILL BE ACCURATE, UNIQUE OR FIT FOR YOUR PURPOSE. Some jurisdictions don't allow these exclusions, so they may not all apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, UPCRAFT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, VIEWS OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE PREVIOUS 12 MONTHS OR US$50. Nothing in these Terms limits liability that can't be limited by law.

13. Indemnity

You agree to defend and indemnify Upcraft against claims arising from Your Content, your Outputs as you publish them, or your breach of these Terms or of anyone's rights.

14. Ending use; governing law

You can stop using the Service and delete your data at any time (Settings → Delete my data). We may suspend or end your access if you break these Terms. Sections 5–7 and 11–14 survive termination. These Terms are governed by the laws of the jurisdiction where Upcraft is established, except where your local consumer law gives you rights that can't be waived.

15. Changes

We may update these Terms. If the changes are significant, we'll give notice in the app or on this page. If you keep using the Service after changes take effect, you accept them.
